Terms and Conditions – Valid Only for Online Sales
Introduction
The online store is operated by MAV ARREDA S.R.L., with its registered office at Corso Lodi 2, Milan (VAT and Tax Code IT05919160969), in compliance with the current regulations on e-commerce and distance contracts in force in Italy at the time of drafting this contract.
1. General Terms and Conditions of Sale
These General Terms and Conditions of Sale (the “Terms”) govern the sale of products marketed on the website mavarreda.it (the “Products”).
All purchase contracts for Products concluded between MAV ARREDA S.R.L. and third parties (the “Customers”) shall be governed by these Terms, which are considered an essential and integral part of every proposal, order, and order confirmation.
The applicable Terms are those in effect on the date the order is placed.
1. Products: Prices and Features
1.1 Unless otherwise stated, the prices of the Products published by MAV ARREDA S.R.L. on the website are expressed in Euros, include VAT, and exclude shipping costs.
Shipments outside the European Union (non-EU) are also net of any customs duties, which will be borne by the recipient and requested by the courier upon delivery.
The price guaranteed to the buyer is the one published on the website at the time of order submission. The agreed price at purchase is fixed and final.
Product prices published by MAV ARREDA S.R.L. on the website cancel and replace previous prices and are subject to the availability of the Products.
Technical and functional features of the Products published on the website are those provided by the respective manufacturers. MAV ARREDA S.R.L. assumes no responsibility for the accuracy or completeness of this information. Product images are indicative and non-binding.
Products are not supplied on a trial basis. Although Mavarreda.it staff may provide information on the characteristics of the Products, the Customer is solely responsible for selecting the Products ordered and for ensuring they meet their specific needs.
2. Orders – Invoicing
Each order submitted to MAV ARREDA S.R.L. constitutes a contractual proposal by the Customer. Fulfilment of the order by MAV ARREDA S.R.L. constitutes confirmation and acceptance of the same.
The tax documentation for the ordered Products will be issued by MAV ARREDA S.R.L. upon shipment.
The invoice will be issued based on the exact billing information provided by the Customer, who is also responsible for providing the correct billing and shipping address.
3. Order Fulfilment
Orders are fulfilled within the timeframes specified on the website.
Deliveries generally occur within 24/48 hours in Italy and within 2 to 6 business days for other destinations, for all Products marked as “available.”
In the event MAV ARREDA S.R.L. is unable to fulfil the order due to unavailability of the Products, it will promptly notify the Customer of the estimated delivery time. If the Customer chooses not to wait (in any case no longer than 60 business days), MAV ARREDA S.R.L. will refund any amounts already paid.
In case of stock depletion or unavailability of the ordered Products, MAV ARREDA S.R.L. will inform the Customer and propose either a new delivery schedule or a refund.
The Customer shall confirm via email whether they wish to wait or receive a refund.
4. Order Confirmation
The contract is deemed concluded upon order confirmation by MAV ARREDA S.R.L.
The Customer will receive an order confirmation email summarizing the order details (products, prices, delivery dates, shipping costs, etc.).
MAV ARREDA S.R.L. reserves the right not to confirm an order for any reason, including supply issues or delivery problems.
5. Product Delivery
Products are delivered to the address specified by the Customer.
Shipments are made only after payment is confirmed. Bank transfers must be credited to our account; credit card payments require transaction approval by the payment gateway.
We use qualified couriers such as TNT, GLS, SDA, or specialized furniture delivery services to ensure service quality and product integrity.
Delivery Timeframes
Deliveries generally occur within 24/48 hours in Italy and 2 to 6 business days for other destinations, only for items in stock. Delivery times are based on business days.
For orders including products with different delivery times, the latest delivery time will apply.
Delays under 30 days do not entitle the Customer to refuse the delivery or request compensation.
MAV ARREDA S.R.L. may choose to split deliveries into multiple shipments.
Delivery and Assembly
Deliveries are made at street level only. Couriers do not carry packages upstairs, nor do they collect old furniture.
MAV ARREDA S.R.L. does not offer assembly services unless agreed in writing beforehand.
Most of our items are pre-assembled and require only simple assembly.
Important Notes
Upon delivery, the Customer must check the contents, conformity, and condition of the Products.
We recommend checking:

the number of packages matches the transport document;
-
packaging is intact and undamaged;
-
contents are undamaged.
If anomalies are found, the Customer must refuse delivery or note detailed, dated reservations on the delivery document.
If the delivery note is signed without reservation, no claims will be accepted regarding the external appearance of the Products.
Any issues must be reported within 3 days of delivery.
MAV ARREDA S.R.L. reserves the right to use couriers of its choice.
Unless otherwise agreed, deliveries are made at street level.
Special delivery terms must be agreed and confirmed in writing.
6. Missed Delivery and Product Return
If the recipient is absent, the courier will leave a delivery notice. The Products must be collected following the instructions provided.
If not collected within the courier’s timeframe, Products will be returned to MAV ARREDA S.R.L., which reserves the right to refund the Products’ price, excluding shipping costs.
In case of delivery error, the Customer must return the Product(s) to MAV ARREDA S.R.L. within 7 days, unopened and in original packaging with all documentation.
Once received in proper condition, MAV ARREDA S.R.L. will resend the correct Product at its expense.
7. Force Majeure
The following are explicitly considered force majeure, in addition to those normally recognized by law:

strikes (internal or external), transport or supply blocks, government restrictions, legal limitations, IT failures, telecom or internet disruptions.
In case of force majeure, order fulfilment will be suspended.
If the situation persists for more than 3 months, the order will be automatically cancelled unless otherwise agreed.
8. Product Warranty – Technical Support
MAV ARREDA S.R.L. guarantees only the physical integrity of Products at the time of delivery (“MAV ARREDA S.R.L. Warranty”).
8.1 Defects must be reported within 10 days of delivery. Under this warranty, the Customer may request replacement of defective Products, excluding any further compensation. Shipping costs for replacements will be covered by MAV ARREDA S.R.L.
8.2 No additional warranty is provided beyond that of the manufacturer. Any warranty service will be provided by the manufacturer, according to their terms. MAV ARREDA S.R.L. makes no guarantee regarding compatibility or fitness for a specific purpose.
8.3 Except in cases of fraud or gross negligence, MAV ARREDA S.R.L.’s liability is limited to the price paid for the contested Products.
9. Right of Withdrawal
9.1 In accordance with Legislative Decree 206/2005, the Customer (if acting as a “consumer”) has the right to withdraw from the contract within 14 days without penalty or explanation.
9.2 The withdrawal period expires 14 days after the Customer (or a third party other than the courier) receives the goods.
The right of withdrawal does not apply to customized or made-to-order products.
To exercise the right of withdrawal, the Customer must notify us by:

using an explicit statement (e.g. a letter or email). The withdrawal form is available but not mandatory.
9.3 Effects of Withdrawal
The Customer will be refunded all payments, including standard delivery costs, without delay and within 14 days of notice.
The same payment method will be used unless otherwise agreed. Refunds may be withheld until the goods are returned or proof of return is provided.
9.4 The goods must be returned to MAV ARREDA S.R.L., Corso Lodi 2, 20135 Milan, within 14 days of notice. Return shipping costs are borne by the Customer.
9.5 The Customer is liable for any loss in value due to improper handling. Returned goods must be in resalable condition.
9.6 The right of withdrawal cannot be exercised for customized or non-prefabricated items.
9.7 Upon delivery, the Customer should check the number of packages and the integrity of the packaging and contents.
If there are discrepancies, the Customer can refuse the package and sign the refusal.
10. Payment
Payment is due at the time of the order.
The Customer agrees to pay the full price (product + shipping) and any import taxes due at delivery.
Accepted payment methods:

Credit card via the website. The Customer guarantees they are authorized to use the card.

Bank transfer to MAV ARREDA S.R.L. (bank details provided at checkout). If payment is not received within 14 days, the order may be cancelled.

PayPal The Customer guarantees authorization for use.
11. Non-Payment – Retention of Title
The Products ordered shall remain the property of MAV ARREDA S.R.L. until full and final payment of their price (pursuant to Articles 1523 et seq. of the Italian Civil Code). MAV ARREDA S.R.L. reserves the right to reclaim the ordered Products in the event of non-payment.
In such case, and upon request by MAV ARREDA S.R.L., the Customer undertakes to return any unpaid Products at their own expense.
12. Complaints
Complaints regarding the non-conformity of the Product(s) delivered with the order must be submitted in writing directly to MAV ARREDA S.R.L. immediately after receipt of the goods.
We recommend that the Customer retain the original packaging and the delivery document.
13. Personal Information
The computer processing of information, including the management of email addresses of website users, is carried out in compliance with legal provisions.
The personal information requested from the Customer is essential for the processing and forwarding of orders, the issuance of invoices, and any warranty contracts.
For this purpose, such information may be communicated to contractual partners of MAV ARREDA S.R.L.
The Customer may object to such communication and, pursuant to the law, may exercise the right to access, modify, rectify, and delete their personal data by contacting MAV ARREDA at Corso Lodi 2, 20135 Milan.
To prevent any attempted fraud, MAV ARREDA S.R.L. may request proof of identity and residence.
14. Electronic Signature
The “validation click” constitutes an electronic signature.
This electronic signature has the same legal value as a handwritten signature between the parties.
15. No Waiver
The fact that MAV ARREDA S.R.L. does not enforce a breach by the Customer of any of their obligations shall not be interpreted as a waiver of such obligation or of the right to enforce it at a later time.
16. Entire Agreement
These general terms and conditions of sale constitute the entire agreement between the parties.
No other general or specific condition communicated by the Customer may be added to or override these terms and conditions.
17. Intellectual Property
MAV ARREDA S.R.L. holds the intellectual property rights of the Website and the rights to distribute the elements contained in the online store catalog.
Therefore, any partial or total reproduction, on any medium, of the elements that make up the Website and the catalog, their use, as well as their transfer to third parties, is strictly prohibited.
18. Severability
Should one or more provisions of these general terms and conditions be deemed invalid or declared as such under a law, regulation, or following a final decision by a competent court, the remaining provisions shall remain in full force and effect.
19. Jurisdiction
In the event of a dispute and in the absence of an amicable agreement between the parties, and without prejudice to the possible application of mandatory legal provisions protecting consumers (as defined in Art.1, letter b) of Legislative Decree No. 185 of May 22, 1999), any dispute related to these General Terms and Conditions shall fall under the exclusive jurisdiction of the Court of Milan.
OUTLET LAGO SALES PROCEDURE
ACCEPTANCE
Once the order has been received and payment completed, MAV ARREDA has 72 working hours to confirm or cancel the order.
If no response is received within 72 hours, the order is considered confirmed.
INSPECTION
With the exception of products described as “new”, all other products may show slight signs of wear, as they have been used for exhibitions, photo shoots, trade shows, or product placements.
Any “major” defects will be indicated in the product description or communicated during the pre-shipment inspection.
If a significant defect is found during the pre-shipment check, the buyer will be informed and may choose to accept the item or request the cancellation of the order.
To cancel the order, simply send an email to store@mavarreda.it. In this case, 100% of the amount paid will be refunded within 7 days.
SALE
As this is an OUTLET, the sale of the products follows an “as seen and liked” basis.
The presence of any signs of wear and/or defects in the Products, duly indicated, does not entitle the Customer to product replacement, price reduction, compensation for damages, or any other remedies.
This sales procedure shall be considered an addition to the general sales conditions of MAV ARREDA S.R.L.’s e-commerce stores.
